Ziccarello v Sanyo Energy (U.S.A.) Corp.

UNITED STATES DISTRICT COURT FOR THE DISTRICT OF NEW JERSEY

Case No. 2:19-CV-16623

A Federal Court authorized this website. This is not a solicitation from a lawyer.

  • On July 8, 2021, a federal court entered a final order approving the Settlement described on this website.  The Settlement became effective on August 10, 2021.  You may download the Court’s Final Approval Order by clicking here .  You may download a copy of the Settlement here.
  • The Settlement resolved a class action lawsuit against Sanyo Energy (U.S.A.) Corporation, Sanyo North America Corporation, and Panasonic Corporation of North America (together called the “Defendants”).  The lawsuit claimed certain Sanyo-brand solar panels “delaminate” over time, which may sometimes result in power loss.  Defendants denied the claims in the lawsuit, and that they did anything wrong.
  • The Settlement generally includes persons who purchased and installed Sanyo-brand solar panels from model series HIP-xxxBA2, BA3, and BA5 model series for residential use, or purchased residential property with Sanyo-brand solar panels from those model series installed on it.  For more information about the solar panel models included in the Settlement, see FAQ3.  The Settlement does not include Sanyo-brand solar panels from other model series, including the HIP-xxxDA3 and HIP-xxxBA19 series.  For more information about how to file a Limited Warranty claim for Sanyo-brand solar panels in the HIP-xxxDA3 and HIP-xxxBA19 model series, please see FAQ27.
  • The Settlement gives class members the right to submit a claim for replacement panels or a prorated cash refund for Sanyo-brand solar panels in the model series described above which are experiencing “delamination” which meets certain visual criteria.  An independent Claim Administrator will review your claim and let you know if any of your solar panels qualify for a remedy.  If they do, Defendants will decide whether you receive replacement panel or prorated refund.
  • The procedure to submit and resolve claims under the Settlement replaces any previous applicable procedures for submitting warranty claims for the above Sanyo-brand solar panel models regarding “delamination.”  Any “delamination”-related claims for these panels must go through the claim process described in the Settlement Agreement and on this website.
  • For more information and answers to frequently asked questions, please visit the FAQ page.  If you cannot find an answer to your question on this website, please call the toll-free settlement hotline at 1-844-702-2787.
